Preamble
These general terms and conditions of sale (hereinafter the "GTC") govern the contractual relationship between the company Atelier SAINT LUC and any individual or legal entity wishing to make a purchase on the website saintlucheritage.com. Any order placed on the Site implies unreserved acceptance of these GTC, to the exclusion of any other document.
Article 1. Scope
These GTC apply, without restriction or reservation, to all sales of products and services offered by Saint Luc Héritage on the Site: handcrafted notebooks and books from the Les Essentiels collection, bookbinding and restoration services, binding of dissertations, theses and guest books, as well as any associated options (gilding, personalization, etc.). They are accessible at any time on the Site and shall prevail, where applicable, over any other version or contradictory document.
Article 2. Identification of the seller
The Site is published by: SAS ATELIER SAINT LUC, with share capital of 105,570 euros, registered in the Trade and Companies Register of the Sarthe under number 30084656500038, whose registered office is located at 24 rue de Carnac 72190 Coulaines, VAT number FR0684656500038. Article 3. Products and services offered
Saint Luc Héritage offers for sale, within the limits of available stocks or indicated manufacturing times:
- hand-bound notebooks and books, in various formats, papers and types of binding, with a personalized gilding option;
- bookbinding and restoration services for items belonging to the customer, with a quote drawn up according to the format and condition of the book;
- limited edition notebooks.
The essential characteristics of each product or service (formats, materials, options, indicative timelines) are presented on the corresponding product page before any order. Certain binding and restoration services require the prior shipment of the book to the workshop and may be subject to a supplementary quote in the event of a complex condition discovered upon receipt.
Article 4. Price
Prices are indicated in euros, inclusive of all taxes (TTC). Unless otherwise stated on the product page, the costs of appropriate packaging and standard shipping are included in the displayed price. Saint Luc Héritage reserves the right to modify its prices at any time; products and services are invoiced on the basis of the rates in force at the time the order is validated. For binding and restoration services requiring a supplementary quote (complex condition, non-standard size, bulk order), the final price is communicated to the Client before any work begins and is only due after express acceptance of this quote.
Article 5. Ordering
The Client selects the desired product(s) or service(s), chooses the available options (format, paper, binding, gilding, etc.) and validates their cart. A summary of the order, including the description of the products, their price and applicable fees, is presented to the Client before final validation and payment. Validation of the order, accompanied by payment, constitutes unreserved acceptance of these GTC. An order confirmation is sent to the Client by email to the address provided during the order. For binding or restoration services requiring the prior shipment of the book, the order is only definitively committed after receipt and evaluation of the book by the workshop and acceptance of the corresponding quote by the Client.
Article 6. Payment terms
Payment for orders is made exclusively online, by credit card, using the secure Shopify Payments payment solution. The Client's account is debited at the time of order validation, except for services subject to a quote for which specific terms (deposit, balance) may be specified in the quote accepted by the Client. Saint Luc Héritage implements all reasonable means to ensure the security and confidentiality of the data transmitted; the Client's bank details are neither viewed nor retained by Saint Luc Héritage.
Article 7. Delivery
7.1 Delivery area
Products are delivered in mainland France as well as internationally, in countries served by the carrier.
7.2 Timelines
Indicative manufacturing timelines are specified on each product page and reiterated during order confirmation; they take into account, where applicable, the additional time linked to personalization options (gilding) or binding and restoration services. The carrier's shipping time is added to these manufacturing timelines.
7.3 Fees
Packaging and shipping fees are calculated according to the nature of the product or service and are included, unless otherwise stated, in the price displayed on the Site.
7.4 Deliveries outside the European Union
For any delivery outside the European Union, customs duties, import taxes or additional fees may be required by the authorities of the destination country. These fees are the sole responsibility of the Client and can in no way be charged to Saint Luc Héritage.
7.5 Inspection upon receipt
The Client is required to check the condition of their package upon receipt and to report any anomaly (damage, incomplete package) under the conditions provided by the carrier, as well as to Saint Luc Héritage as soon as possible.
Article 8. Right of withdrawal
In accordance with articles L. 221-18 et seq. of the Consumer Code, the consumer Client has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their reasons or incur penalties, with the exception of return costs. To exercise this right, the Client shall notify Saint Luc Héritage of their decision by any unequivocal written means (email or postal mail), then return the product in its original packaging, in perfect condition, within 14 days following this notification.
In accordance with article L. 221-28 of the Consumer Code, the right of withdrawal cannot be exercised for:
- products made according to the Client's specifications or clearly personalized, in particular notebooks and books featuring a gilding option (initials, first name or inscription);
- binding and restoration services performed on a book provided by the Client, as these are carried out on a bespoke basis using a good belonging to them and according to their specifications.
Article 9. Returns, exchanges and refunds
When the right of withdrawal applies, the refund will be made within a maximum period of 14 days from receipt by Saint Luc Héritage of the product returned in new condition or proof of shipment of the same, whichever occurs first. The refund is made using the same payment method as that used for the order, unless the Client expressly agrees to another method. Return costs remain the responsibility of the Client, unless otherwise specified on the Site. A product returned incomplete, damaged, or soiled by the Client will not be accepted.
Article 10. Legal guarantees
Independently of any right of withdrawal, all products sold by Saint Luc Héritage benefit automatically and at no extra cost, in accordance with legal provisions:
- from the legal guarantee of conformity (articles L. 217-3 et seq. of the Consumer Code), for two years from delivery of the good;
- from the legal guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
Within the framework of these guarantees, the Client may choose between the repair or replacement of the good, subject to the cost conditions provided for in article L. 217-9 of the Consumer Code. These guarantees do not cover damage resulting from abnormal use, normal wear and tear, lack of maintenance or intervention by a third party not authorized by Saint Luc Héritage.
Article 11. Liability
Saint Luc Héritage cannot be held liable for non-performance or poor performance of the contract in the event of force majeure, the unforeseeable and insurmountable act of a third party, or the fault of the Client, particularly in the event of an error in the delivery information provided during the order. For binding and restoration services concerning a book provided by the Client, the liability of Saint Luc Héritage is limited to the value of the invoiced service, except in cases of gross negligence or wilful misconduct duly established.
Article 12. Intellectual property
All elements of the Site (texts, images, logos, layouts, graphic elements, etc.) are the exclusive property of Saint Luc Héritage or its partners, and are protected by the Intellectual Property Code. Any reproduction, representation or exploitation, in whole or in part, without prior written authorization, is prohibited.
Article 13. Personal data
Personal data collected during the order is processed by Saint Luc Héritage for the purposes of order management, customer relations and, where applicable, commercial purposes with the Client's consent, in accordance with Regulation (EU) 2016/679 ("GDPR") and Law No. 78-17 of January 6, 1978, as amended. The Client has the right to access, rectify, erase, restrict, object to and port their data, which they may exercise by writing to info@reliuresaintluc.com. For more details, the Client is invited to consult the Site's privacy policy.
Article 14. Complaints and mediation
For any complaint, the Client may contact the Saint Luc Héritage customer service at info@reliuresaintluc.com. In accordance with articles L. 616-1 et seq. of the Consumer Code, in the event of an unresolved dispute, the consumer Client may use the mediation service of the Le Mans Commercial Court free of charge. The Client may also use the European online dispute resolution platform, accessible at https://ec.europa.eu/consumers/odr.
Article 15. Governing law and disputes
These GTC are subject to French law. In the event of a dispute, and after a prior attempt at amicable resolution (notably via the mediation provided for in Article 14), the competent French courts shall have sole jurisdiction to settle the dispute, under common law conditions.
Article 16. Acceptance of the GTC
Validating an order on the Site implies full and complete acceptance of these GTC by the Client, who acknowledges having read them before ordering.
